Italian government approves implementation of EU directive on “tourist packages”

To avoid penalties of the European Commission, the Italian Council of Ministers, chaired by Paolo Gentiloni Silveri, has sped up the approval of the legislative decree for the implementation of the regulations on the European directive in theme of “Tourist packages and tourist services”.

The text launched in recent days takes into account the observations and evaluations of the Special Commissions of the Chamber and Senate and the State-Regions Conference, according to Unionturismo news, the Italian news release for Federturismo-Confindustria.

The reference to contracts concluded in the territory of the State is eliminated in order to cover a wider range. The concept of “tourist packages” is extended (also online, tailor-made and “dynamic” packages) which must be formed by at least two services and purchased at a single point of sale. Combinations are excluded in which tourist services other than transport, accommodation, vehicle rental are of little relevance.

In the contract, compared to the current regulations, more consumer rights are recognized in case of withdrawal by the customer. In case of incorrect execution of the package, the buyer will have to provide a reduction in price with the possibility of refund.

The limitation period has also been increased: 3 years for personal injury and 2 for other damages. It is also foreseen that the seller is responsible for the execution of the mandate given to him by the traveler and is considered as an organizer in case he fails to provide all information to the trip.

The seller is also required to obtain mandatory insurance for civil liability and enhanced guarantees for the traveler in the event of insolvency or bankruptcy.

The new category of “linked travel services” is inserted (combination of two different types of tourist services). These also have protective measures in the event of insolvency or bankruptcy. In case of violation of the rules by the seller, administrative and pecuniary sanctions range from 1,000 euros to 20,000 euros.
